These Terms form a binding agreement between you and Daafrak Enterprise Ghana (“Daafrak”, “we”, “us”). If you do not agree, please do not use our site or services.
1) Acceptance of Terms
By accessing our website, requesting a quote, scheduling a consultation, or purchasing services/products, you agree to these Terms and our Privacy Policy.
2) Changes
We may update these Terms at any time. Continued use after updates constitutes acceptance of the revised Terms.
3) Services & Estimates
- Scope: We design, install, and maintain solar systems; provide audits/consultancy and related products.
- Estimates: Quotes, savings projections, and calculator outputs are estimates for planning only; actual results may vary.
- Site conditions: Final designs depend on site survey, utility/policy requirements, and component availability.
4) Accounts & Conduct
You agree to provide accurate information, keep credentials secure, and use the site lawfully. We may suspend access for suspected misuse.
5) Orders, Pricing & Payments
- Deposits: Unless stated otherwise, a 70% deposit is required to commence work; the balance is due before deployment.
- Invoices: Payable by the due date shown. Late or failed payments may delay work or incur charges permitted by law.
- Taxes/fees: Prices may exclude taxes, permits, and utility fees unless explicitly included.
6) Cancellations & Refunds
- Cancellations before procurement/scheduling may be eligible for partial refund net of admin/engineering costs.
- Custom-ordered equipment or completed labour may be non-refundable. We’ll disclose any restocking fees where applicable.
7) Warranties & Support
- Products: Panel performance up to 20–25 years; inverters 3–5 years; batteries 2–5 years; streetlights/accessories 1–2 years (per manufacturer terms).
- Workmanship: 1-year installation warranty unless specified otherwise.
- Warranty claims require proof of purchase and proper system use/maintenance.
8) Acceptable Use
No unlawful, infringing, harmful, or disruptive activities. Do not attempt to interfere with the site, collect data unlawfully, or impersonate others.
9) Intellectual Property
Site content (text, graphics, logos) belongs to Daafrak or its licensors and is protected by IP laws. You may not copy, modify, or distribute without permission.
10) User Content & Testimonials
If you submit reviews, photos, or testimonials, you grant Daafrak a non-exclusive, worldwide licence to use and display them for marketing and service purposes, subject to our Privacy Policy.
11) Third-Party Links
External links are provided for convenience. We are not responsible for third-party content or practices.
12) Disclaimers
Except as expressly stated, services and the site are provided “as is” and “as available” without warranties of any kind, to the fullest extent permitted by law.
13) Limitation of Liability
To the maximum extent allowed by law, Daafrak is not liable for indirect, incidental, special, or consequential damages, or lost profits. Our aggregate liability relating to the services is limited to amounts you paid to us for the specific work giving rise to the claim.
14) Indemnification
You agree to indemnify and hold Daafrak harmless from claims arising out of your misuse of the site/services or violation of these Terms.
15) Force Majeure
We are not liable for delays or failures caused by events beyond our reasonable control (e.g., supply chain issues, weather, utility/permit delays).
16) Governing Law & Disputes
These Terms are governed by the laws of the Republic of Ghana. Disputes shall first be resolved by good-faith negotiation; if unresolved, the parties may pursue appropriate remedies in competent Ghanaian courts.
17) Miscellaneous
- Severability: If a clause is unenforceable, the remaining Terms remain in effect.
- No waiver: Failure to enforce a provision is not a waiver.
- Entire agreement: These Terms + referenced policies form the whole agreement.
- Not legal advice: Site content is informational; please obtain independent legal/financial advice where needed.
